1 Scope of application
1.1 The general terms and conditions of Wellness & Movement, Finca Calma Verde apply to all legal relationships between Wellness & Movement, Finca Calma Verde, represented by Doris Träg (hereinafter referred to as ‘owner’), and its customers.
1.2 Upon initiation (application for admission) and commencement of the service, the customer accepts the general terms and conditions. They form the basis of the content of the contract.
2. Work with the animal
2.1 The services offered on the animal are carried out to the best of our knowledge and belief using the means and knowledge available.
2.2 The animal owner is obliged to provide truthful and complete information about the state of health of the animal and to answer all questions truthfully before the start of the service. Changes in the state of health must be reported before the start of an application.
2.3 The animal owner must ensure that his animal is adequately vaccinated, especially during group training sessions. Proof of vaccination status must be provided by submitting the vaccination certificate or EU pet passport.
2.4 The services are carried out to the best of our knowledge and belief and are based on the individual needs of the animal, depending on its species, breed, age, sex and physical condition. The possibilities of the animal owner are also taken into account. Any additional costs incurred will be disclosed to the customer in advance.
2.5 The pet owner or a supervisor appointed by him must be present during the performance of the services.
2.6 The owner is entitled to refuse a service or to cancel a service that has already begun without giving reasons. In the event of cancellation by the owner, any subsequent appointments already paid for will be refunded.
2.7 As a rule, the wellness services and, if applicable, nutritional supplement consultations offered are not recognised by conventional medicine and are therefore not used to treat illnesses and therefore do not promise any cure. In individual cases, so-called initial reactions/first exacerbations of symptoms may occur after a service. The pet owner will be informed about this and the choice of application will be adjusted if necessary. The owner does not guarantee success in the area of wellness services or massages and makes no promises of cure.
3. Making/cancelling appointments
3.1 Agreed appointments are binding. They can be arranged by telephone, in person, by e-mail, SMS or WhatsApp.
3.2 If the application of the service takes place outside Finca Calme Verde, the costs for travelling to and from the appointment are to be borne by the pet owner.
3.3 In the case of home visits, there may be delays due to unforeseeable disruptions in road traffic or due to weather conditions. If the pet owner has left their telephone number or mobile phone number, they will be informed of the delay immediately if possible.
3.4 If an appointment cannot be kept, it must be cancelled at least 24 hours before the appointment by telephone, text message or WhatsApp. This will not incur any costs.
If an appointment is not cancelled or not cancelled in good time, the costs that would have been incurred if the appointment had gone ahead as planned will be charged in full.
Payment for the missed appointment will be made at the latest at the next appointment or after invoicing.
If the cancellation is due to a medical emergency, the costs for the missed appointment can be partially waived after consultation with the owner. The prerequisite for this is the provision of appropriate proof.
If the appointment is cancelled by the owner, there is a binding right to an alternative appointment.
4. Costs and payment
4.1 The proprietor is entitled to a fee for his services, which can be found on the homepage.
4.2 Payment shall be made in cash or on account following the provision of the service.
In the event of late payment by the pet owner, a single reminder shall be sent; the reminder fee charged shall be EUR 5.00. If payment is then not made within the statutory period, the case will be handed over to a debt collection agency without further notice and the judicial dunning procedure will be invoked.
4.3 The customer has the option of paying in advance for a series of appointments. The agreed dates are binding.
4.4 Discount cards must be paid for before the first appointment.
4.5 In the event of the death of an animal during an ongoing and prepaid series of appointments, the owner may refund partial amounts as a gesture of goodwill. There is no entitlement to a refund.
4.6 The transfer of discount cards to another pet owner and/or another animal is not permitted.
5 Exclusion of liability
The owner accepts no liability whatever for
- aids and equipment purchased by the pet owners themselves
- improper use of the aids and equipment recommended by the owner,
- improper, unprofessional or inappropriate treatment of the animal by the keeper
- damage caused by the animal, e.g. to premises, furnishings, equipment or the owner himself
6. Release from professional confidentiality
The animal owner expressly releases veterinarians and other therapists who treat the animal in question from their duty of confidentiality towards Wellness & Movement, Finca Calma Verde. Wellness & Movement, Finca Calma Verde is entitled to request diagnostic information from the vet and to consult the treatment plan in order to optimise the services and training to be provided.
7 Changes to the general terms and conditions and prices
Wellness & Movement, Finca Calma Verde is authorised to change the general terms and conditions and prices at any time.
